I purchased an item for my car from a private seller, the item was faulty so i emailked him and we agreed i would send it back for a refund. I sent the item back to him recorded delivery and he contacted me to say he had received it back, but would have someone look at it and get back to me. I emailed him straight back and stated i no longer wanted it as i had ordered one from another source as his was faulty and could he refund my money, never heard a thing. Taken it up with paypal for a claim, but if i win i still dont think he will pay up, what else can i do to get my money back, cant go round and knock his door as we are hundreds of miles apart. Any advice would be appreciated

Was it an expensive item? If you win the Paypal claim (which should be very straightforward since you have evidence that you returned the item), Paypal can take the money from his account, but if he doesn't have sufficient funds in his Paypal account at the time, then it gets a bit more complicated, and you might never get a full refund. If your Paypal payment was funded from a credit card, you may be able to claim through your credit card company if Paypal fails to obtain your refund.0

it was for £50 which i cant really afford to lose, it wasnt paid on a card to paypal and it seems unlikely he will have the money in his account.

The reason I imagine the seller is not contacting you is you never gave him a chance to sort the problem out and purchased elsewhere, which is a little unfair.
In saying that though the seller should refund and assuming you have proof of return (and he is still selling ie money going through his PayPal account) then a claim should succeed.0 -
It was about 12 days between me getting the item and discussing it with him, then he had it back for over a week with no contact, i know he had been on his com etc as he purchased other items in that time scale, think he's just one of the many rip off merchants on there, shame as it spoils it for the rest0

Anybody think its worth going through small claims court, if only to show him he cant get away with this, may stop him trying it with someone else0
