DVLA offering me an out of court settlement.. for £491?!!!
After making the mistake of leaving my car untaxed while sorn on a public road, it was clamped, I paid the fine and got a tax disc thought that would be the end of it..
Now have got a letter from the DLVA offering an out of court settlement (OCS) of £491! .. how do they arrive at such a high figure?!
It probably doesn't matter to them, but i couldn't move the car if I tried.. it broke down after an MOT (succesful aswell!) and is not at all safe to drive (cutting out problem)
The car in it's current state isn't even worth that much money, and further it's not been fixed because I have no money being a student who's just about scraping by..
Can anyone advise me on the best course of action?

The clamping fine was for not displaying a tax disc, this new one is having a SORN on-road..
I taxed it as soon as it got clamped, otherwise you don't get the £160 surety fee back.. tax was only £120 for 6 months so made sense!0 -

None of this is making sense to me, you SORN'ed a car that has valid road tax on it ???
If you left an untaxed car on the road that was SORN'ed, then sorry, you have been dealt with properly, you breached the terms of the SORN.0 -
I agree with Inactive, you may have left the car on the road entirely by accident but that's what they all say. Your car had no tax disc and it was on a public road, if it had been just outside of your home they might have turned a blind eye but your car was illegal.0

sounds a bit confusing OP.
do i have it correct here goes:
1. it had no tax and wasnt SORN'ED and was on a public highway so it got clamped.
2. you taxed it and had the clamp removed and paid the fine?
3. your car is now road taxed and is entitled to be on the public highway, but you have declaired it SORN?
4 you have now recieved a higher fine from DVLA.0 -
So you've taken them to court for wrongfully clamping you, and they have now offered you £491.00 as an out of court settlement.
I would take the money.

It sounds like you are being fined twice for the same offence - failure to display a tax disc and failure to declare SORN.
I can't see how you can be fined for both.0 -
My take:
Car was SORN'ed but left on the road. The car was clamped and a tax disc bought plus the costs paid for at the time. DVLA are now going for the period that the car was SORN'ed but left on the road.
Could be totally wrong though.
But if I am right, SORN is about take the car OFF ROAD not leaving it on the road.There is a race of men that don't fit in; A race that can't stand still;
