HMV earphone returns

Hi MSE,

This is my first post here so I apologize if I break any rules or anything :D

To cut a long story short: I bought a £35 pair of headphones from an HMV store today and they are advertised as "noise isolation" which means a "vacum" is created in each ear to stop noise/hold the earbuds in. The right hand earbud, however, does not "click" into this "suction" position like the left and as such I am left with an earbud being held in by friction and thus reducing the sound quality/my enjoyment of the product.

HMV have on their website:
"Headphones: In the interest of hygiene hmv will be unable to exchange or refund any headphones that have been opened and used, unless they are proven faulty."
So essentially I want to go into the store tomorrow with the packaging, receipt and product and present to them my argument; where do I stand here? If they are arsey about it and cannot "prove" that it is faulty in the store, will they send it off to their offices or something or outright refuse a refund, if so, what are my options? I am thinking the following:


- Product not fit for purpose
- Product does not meet specification
- Product is not as advertised

    So you bought earphones or headphones?

    If you can hear sounds through them they work, Suction headphones/earphones will only hurt your ears in the long run.
  • If you have used them properly (Which I'm sure you have) worst case scenario they'll send them off to be looked at before replacing them or refunding your money.

    If you have the receipt, Just pop in and ask. I'm sure it'll be fine

    Seriously though have you tried the different cap sizes? you may need to change them to get a better fit.

  • Thanks for all the replies; I went in today and they gave me a full refund (albeit with a bit of mumbling and looking at me strangely!).

    HMV's policy is generally avoidance of refunds (pointed out by the returns agreement) - while it's almost never refused (which would be illegal) it's generally policy to offer a GC/exchange first as regular staff generally aren't authorised to give refunds, but generally speaking half of the staff would just fill in a faulty sticker saying "no sound in X ear" anyways.
    Retired member - fed up with the general tone of the place.
