HMV.co.uk mislead me!

Hey everyone,

well I recently (4 days ago) placed an order for a Nintendo Wii on the HMV.co.uk website - it was on there at £179.99 (which is the same price you will pretty much find it everywhere else). When I went to the checkout to preorder it my student discount automatically took 10% off the total bill so it was down to £161.99!!! As it was so cheap I decided to pay the extra fiver and get it recorded delivery so it was £166.99 which is still a good £13 cheaper than anywhere else.

I thought this was excellent and I read the terms and conditions to check if it allowed me to get the discount and it does state that you can't get student discount on hardware on their site or in their store. However, I was sent a confirmation email and everything stating the cheaper price - i was happy as!

I then received an email yesterday which said:

"Dear Phil,

yadda yadda yadda....

I regret to inform you that we are unable to proceed with your order for a NINTENDO WII CONSOLE with a discount applied.

We would be happy to progress your order at our normal retail price of £179.99, and I would be grateful if you could confirm by responding to this email whether you wish to proceed with the order at the amended price.

Once I receive a response from you to confirm the price, I will arrange for the order to be processed."

I replied stating that they had mislead me as their system took the 10% off automatically because I have my student card details on there. However the "lovely" lady just said that it clearly states in the terms and conditions that you can't use student discount ... yadda yadda yadda..

Is it just me, or is it HMV's fault for doing the discount automatically - surely they can't tell you they will sell it to you at one price then say oh no we're selling it to you for £13 more....

Do you think there is any point in taking this further like writing to Customer Services again? I'm new to all this so any advice would be great!

Cheers

argh I spelt Misled wrong in the subject...don't I feel silly! :)

Legally, HMV have done nothing wrong however you can argue that the customer service you've received is poor (I would).

They could offer you the item at the original price but that would only be goodwill gesture. If you keep arguing with them, they might let you keep the discount.

Offer to accept the amended price, but as a good will gesture they should throw the recorded delivery in for free ;)

Well its not as good as you originally thought but at least you got something knocked off.
  • wow that was weird. As soon as I checked this thread again I noticed I had an email from HMV about my preorder:

" We are writing to let you know about the Nintendo Wii order you placed with us at HMV.co.uk.

We're very sorry to tell you that, because there weren't enough consoles available from the manufacturer, we'll be unable to fulfil your order on the first day of release. Sadly, the limited supply we received means that only those customers who placed their orders very early on will have a chance of getting their consoles in time for Christmas.

We apologise for this disappointment and will endeavour to secure more Wii consoles from the supplier, getting yours to you as soon as we receive additional shipments. Should anything change, we'll be sure to contact you right away.

We fully understand that you may wish to cancel your order at this point. If you wish to do so, you can access your account details by Clicking Here>>>"

    !!!!!!ing B**tards!!

I just called around some toy shops from home and found one store with ONE place left on their preorder list. That means I can receive the game on release day, I wish i had done that from the start!

Just thought i'd let you know!!
