:(Please help original debt in ???? £5609 by amex was handed to Robinson way about 18mths ago I have paid religiously £25 a month no problem I have had to take a pay cut of 20% or lose Job so I took pay cut. I have been out the country 80% of the year so my partner has been getting harassed by them 5 and 6 times a day if I do get home it is late sat and back sun so i have not returned their calls.
Now Horwich Farrelly have sent a letter have been assigned the benefit of the account due to insufficient payments and that RW have instructed them to apply to the court to issue proceedings. If I fail to make reasonable instalments.
As my salary has reduced I just cant afford to increase this what can I do.

You may bed to send them a SOA so that they can see exactly what you can afford. You need to be looking at all your outgoings and see if you can reduce certain spent to put more towards repaying the debt....0

Hi there I am new to this site, am confused as I have had Robinson Way chasing me for a debt that I was unaware even existed and i do not know where it came from so i ignored them in the hope they would go away. However this morning I have received a letter from Horwich Farrelly stating that they will be taking me to court if I do not make a full or substantial payment. I do not know who this debt is for and I have been in my current address for 5 years and have not had any credit in that time. I have checked my credit report and there is no mention of this debt on there. I am confused as to what I should do next, any advice would be greatly appreciated. xx0

Hi Confused and welcome
First step with a debt like this would be to send a prove it letter requesting that they prove you owe the money and that they are allowed to collect the debt.
That should mean they will provide you with details as to who the original creditor was etc. Prove it letter here - http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2
This letter also is carefully worded so you are not admitting that you owe any money to them. Best to send recorded deliv and to print/type your name rather than sign it.

Hi, I too have been experiencing trouble with Robinson Way. I had a debt with London Scottish which I had an agreed payment plan through a charity debt management team. All was fine till Robinson Way took over, to which payments were changed from London Scottish to Robinson Way which they agreed to. Later they sent me a letter saying they would close the account of over 3,000 if I made a payment of just £25, well to my shock, but I wasn't going to look a gift horse in the mouth. I contacted my MDA of which I was told they had also been made aware of this offer by phone & was making the payment of £25 & then closing the account. This was done & I thought it was all over (wishful thinking!!). I moved homes over 2yrs ago now to where I reside now, and paid for a mail redirection for 3months from old address to new address. I recieved all mail for actually 4monthes with no letters from Robinson Way. then over a year ago now I recieved a letter demanding payment of the debt they had supposedly closed with the £25 payment, I got in touch with them & inoccently gave my home number, big mistake) even tho I said they closed the account with the payment they say they never & do I still have the letter to prove it, they have harrassed me since for the money & keep threatening to send someone round to make a collection & threaten court action. Last year I sent a Data access request recorded delivery, but they ignored it, each time since when I've spoke with them they keep asking do I have the letter, I tell them yes somewhere but not sure where as it was over 2years & I moved in that time, they ignore when I ask about my letter asking for Data access request, they just say 'your wanting a statement sent to you? which I reply, No I want everything you hold on me in connection to this account. They have sent statement twice which actually shows that at the time the £25 payment was made to close account they brought the account to a 0.00 Balance, but when you ask well why does it show that for same period they just deflect question & repeat do I have the letter to prove.My question is if they really believe I owe this money still & they didn't make a boo boo in sending a letter suggesting closure of the account with a £25 payment, then why is it taking so long to send it to courts, why are they still chasing me through calls & letters more than a year after. They have now sent letters from there solicitors Horwich & Farrelly(which I notice hold the same address)the 2nd letter states I have 10days to answer & make payments or they start court proceedings.I am now about to send another Data Access Request letter with a £10 postal order for the charge of that to be carried out & am sending it this time by special delivery so I can actually track that they have signed & recieved it.
I would welcome any suggestions or help from anyone especially to if they know how I stand on this, do they have a case can they do anything, could they take this to court & what would probably happen if they do. Urgently need some help & answers please.0
