car insurance claim advice

Options
Hi,

Recently my dad was involved in a collision - heading from a side road onto a dual carriageway, my dad stopped. The guy behind didn't.

The other driver's insurance company has assessed my dad's car and decided they don't want to repair it. It's an old car but running well and the amount they have offered is barely enough to get him mobile with a beat up old banger. Can they do this? It doesn't seem right to me, my dad was not at fault and he doesn't want a new car and certainly doesn't want the additional expense of getting a car worth having.

all opinions welcome, any advice accepted gratefully. Thanks.

You can't get them to repair it if that is uneconomical.

But they should give you the market value. You need to find evidence they aren't doing this and appeal their offer with your evidence..
  • hmm.. think I jumped the gun a bit - garbled mis-information from a frustrated mum :o

Spoken to dad now - the insurance company haven't yet made their settlement offer, he just naturally expects them to offer !!!!!! all squared. Seems he was also considering trading it in for a slightly newer one in a year or so anyway. I've suggested that if the settlement offer is higher than the expected trade in value he might actually be better off.

    Cheers

  • If the vehicle is written off your father could ask to retain the salvage, providing the insurer allows it. This would mean your father would get to keep the car and also receive a reduced amount of money. Might be option if he wants to keep it.
