Pension advice needed

Hi all,
I wonder if anyone can help me, I have been married to a soldier for 15 years, 3 years ago he had an affair and I left the marriage, until now he has refused to agree to a divorce (filed twice) finally he has gotten engaged and now wants a divorce.
I am trying to find out what the entittlement is to his pension, I have been told im entittled to 50% of his pensioned earned for the duration of our marriage. I am going to apply for a lump sum payment as I wish to end all aspects of the marriage and get on with my own life.
We have children which he does pay for.
Any advice just in regards to the pension would be really great.

You are only entitled to a pension at 60. Basically they start an armed forces pension for you in divisions of 32 years max service, so if you were married 10 years they give you (for example) 5/32 of a pension to be paid at 60. His pension is reduced immediately he draws it.
If you decide to go for his pension you get to 'agree' your years entitlement.
You would be better off agreeing a lump sum with him and leaving his pension alone? If you don't you won't see that money for a long time. This is how some of my mates in the armed forces have handled their divorces to get closure.Politicians and diapers have one thing in common. They should both be changed regularly, and for the same reason.0 -

Yes Its his lump sum im after ad he is talking about changing over to auz army, and I know that if i ever get remarried its going to end my claims to his pension ect. just to many issues to drag out I want it over and done with.

I am sorry to hear about your situation. You are entitled to 30 minutes free legal advice. Forces Law offer legal advice to Service families and operate throughout the country. Can I suggest you visit the Forces Law website to find your nearest operative. They will be able to provide you with all the options. I did see a little leaflet at work the other day about pensions and divorce! now thats ppppp's for you.
But seriously I did not read it, as im not looking to get divorced, but I should imagine it was written with the serviceman in mind, not the supporting other.
