    If you, or others, have evidence that 'some' advisors are saying this to claimants then I would report it to the office manager or whoever it should be going to.

    I think its possibly a DPA matter. ATOS dont need the info therefore there is no reason for them to have it in their possession and it shouldnt be retained even for a short period of time.

    DWP must work differently from where I work - claimants are often advised to send in as much info as possible - it is their responsibility.


    ATOS do need evidence, the medical professional doing either the pre-board report or the actual main lima report have to comply with the relavent professional body guidelines, usually the GCM or NMWC.

    Both require accurate reports to be done, and for all evidence to be taken into consideration etc etc.

    ATOS have apologised in writing for not reading my additional information that I sent in with the form, cant see them doing that if they had a way they could get out of having to do so. They referred to it as an oversight, and said steps would be taken etc.

    I beleive the DWP are reprinting all the ESA type forms anyway in march or so due to implementing the harsher rules....
