Tragic yes but how exactly should the school have acted to prevent this?

  • I thought exactly the same, today everything that goes wrong needs someone to blame and get compo. Society is heading for a big fall in this country when we run out of useful people to pay for the ever increasing amount of "me me me I's"
  • This is completely different from those "Had an accident at work, but are now completely recovered, but want some money? After all it was only a bruise, you had forgotten about it until you saw this advert, but now think of the big TV and holiday you can buy." adverts and what has happened here.

    This kid is going to be brain damaged for the rest of their life. What do you expect the dad to do?

    I have to agree with Mrfish_bulb as this is in no way the same as ambulance chasers etc this young man will need care for all his life and has his chances of finding employment severely limited what else could they do?

    While I have every sympathy for the family, I really cannot see how there is any blame or justification for compensation. The child could just as easily have been injured at a desk if he had been knocked forward when he was holding a brush or even a pencil. I don't think the family are 'compensation happy'/jumping on the compensation bandwagon - they obviously want to do the best they can for their child - but I can't accept the way in which a search for someone to blame is made after any sort of accident.

    Different if there has been negligence - but I can't see there was any fault in this at all. At this rate, school will be banned from so many normal activities that it won't be worth sending children to school!

    I think this is one that may be appealed. While I have every sympathy with the boy and his family, a judgment of this type could cause all kinds of problems in schools up and down the country.

    What has happened to the young boy is very unlucky and sad, but just because someone is very badly injured doesn't always mean someone (or someone else) is to blame. I think it's too easy sometimes just to assume that someone is entitled to compensation because they have been injured. Not that I'm suggesting for a moment that the judge hasn't properly considered the evidence, and, of course, there may be other factors that we don't know about.

    But if it really is as simple as has been reported, then I suspect that the council will be considering an appeal.
  • I agree. The council do seem to be appealing it. I don't actually see how it has won. The whole neglience etc just isnt there.
  • Terribly sad story and i am pleased the council are appealing it as it could set a dangerous precedent across the country.

    I can only assume that the judge went in the boys favour because they were on the floor hunched over rather then at a desk.

    I assume that from now on every school must use flexible rubber paint brushes, safety goggles for painting and must equip every child with one of those car reverse sensors (the ones that bleep).

    I mean come on, it was an accident, nothing more. If anything, sue the girl who bumped into him and the kid who was holding the paintbrush in a position for him to land on it, they're the ones who caused this to happen.

    nasty but i cnat see how this is the schools fault or should school kids now be banned from using pens pencils brushes etc

    i think its terible that everyone tom,!!!!!! and harry feels they have the right to sue nowadays!
    my dad said that a boy fell backwards onto a pencil that pierced through his back,i was classed as an unfortunate accident not an oppurtunity to get thousands in compensation


    however i am more annoyed by the case of the teacher sueing because she lost her voice than this one
