Redundant whilst pregnant

Just looking for a bit of advise with regards to redundancy whilst pregnant. Here is my story:

Well i am currently 16+5 weeks pregnant and had a formal meeting yesterday to confirm my redundancy. The whole client services department is being redundant, the same in 3 other offices. In our office one girl is already on mat leave so not sure of her leaving date, team leader has leaving date of 25th Jan and the other team member has the same leaving date as me. Our clients are then being transferred to another one of our offices. My notice period is 4 weeks starting 1st Dec 2010, however they have extended this to 6 weeks and 2 days to the 14th Jan, so this will be my last day. My baby is due on 5th May. I will hit 25 weeks the following Thursday on 20th Jan therefore am i right in thinking i will not qualify for SMP from my employer? Or....will i be 'in' my 25th week of pregnancy that week? I can not prove that they have chosen the 14th Jan because it is before my 25th week of pregnancy. Redunancy package is not very much: half a week for every year i have been here and they are paying 1 month tax free as a good will gesture. If the redundancy terms are agreed (all should be finalised by 1st Dec) but then i go for my 20 week scan and they bring my due date forward by a week, would my employer then have to pay my SMP? How can i prove to my employer without the MATB1 form how many weeks i am pregnant. I am not due to get this form until 25 weeks.

Any advise would be appreciated. If you need any more info please just ask.

Thanks

Hayley

  • Hi There

I think you should therefore be entitled to Maternity Allowance if not SMP. But juts check with CAB or on the net. It will depend on how much you have earnt over the last so many weeks etc.

My friend only worked 3 months out of the previous 18 months part time too, and she got maternity allowance, which was more than she used to earn!!.

But yes, if you can't get SMP, I'm sure you would qualify for MA.

    Good Luck.

Are you aged 22 or under? (if not you may be entitled to more)
Check that you are receiving at least the minimum statuary rates here
