Disability Living Allowance Help Advice Please

I applied for DLA in October was refused they used an ATOS report from January for ESA which I appealed and won in september.

Now I appealed the decision submitting a copy of the tribunal decision, reports from Gp and medical professional which I used for my esa appeal and also discharge form etc.

Now the DLA have requested a factual report from GP, is this a good thing or bad??

Would a GP report lapse an appeal?
Why are they requesting a report when I submitted a load of evidence with the claim pack from my GP.

Please Advise!!!!

    It is a good thing because it shows they are considering your appeal fully. I'm not sure what else you want to know?

  • Why ask at this point though surely they should have requested it before refusing me and putting more stress on my mind.
    Also are people who suffer from anxiety and panic attacks eligible for any rate of mobility??

    You would need to ask the Decision Maker that - no one here can tell you about what is happening in a specific case.

    Those with MH problems may qualify for LRM and in very limited circumstances HRM. Plenty of people get LRM for needing support whilst they are out and about.

    The mobility rate normally awarded for those with mental health issues - anxiety/panic attacks is the Low Rate:

    Low rate Mobility is for those who can walk but need to be guided or supervised in a place they do not know.

    You need to show very clearly that you feel unsafe and could endanger yourself or others as a result of a panic attack [the fight or flee reaction]

    Always ask for a reconsideration and if that is unusccessful go for an Appeal. Never given in or give up.
