Someone run into my daughter at a junction, her handbrake was on and she was stationary but somehow has full blame. No witnesses etc. and she has lost 1 years ncb. Other driver is now taking her to court for loss of earnings and injuries, she suffered whiplash herself and is claiming but she is worried now she will lose more ncb, any ideas?

    When you have an incident which results in you being held at fault, then you are only lose your NCD once for the incident.

    You normally lose 2 years of any NCD you held at the time of the incident, and none is awarded for the year in which the incident ocurred.

    As you say your daughter has only lost one year then was that all she had? Otherwise there may be a misunderstanding about this.
  • Thanks for that, she had 2 years NCB before the incident and lost one years on renewal. The court date is May 2011.

    Sounds a bit strange to me ?

    Surely if someone ran into your Daughter when she was stationary then fault would lie with the 3rd party?

    Also seems strange to be going to court to claim loss of earnings etc as surely this is usually claimed back from the insurer of the at fault driver ? It was in our case anyhow.

    Have you got legal cover on the policy ?

    The other driver claimed she pulled out in front of him but as I said, the hand brake was on and she never moved. To make it worse he is a taxi driver who has a string of claims for similar bumps. The insurers sided with him and my daughter is furious.

    It does sounds rather odd.

    What can sometimes happen where there are no witnesses or compelling evidence is that cases go 50/50 where no-one can agree.

    She needs to be speaking to her insurers and finding out why this has gone against her.

    However she will not lose any more NCB if the claim increses. One claim is one claim for the purposes of NCB.
    Where premium loadings are concerned (she will have to declare a fault claim) having injuries is worse because it's more expensive, so from that perspective, she could be penalised more, but there is nothing she can about the other person putting in an injury claim.
