ebay item not as described

Hi, I recently purchased an item from ebay which on delivery was not as described. It was actually a pair of boots and described as lightly worn but on receipt the heels and soles are 'smooth' in places and don't seem lightly worn to me but the seller is arguing the point! I was told that I can return them and once 'checked' and after I've left feedback a refund will be made.
I contacted seller again and asked if a partial refund could be considered but the response was NO as I'd got them for a bargain price.
I don't know what to do now - if I return them I will loose out as the return postage will be fairly high and I'm sure that once received and 'checked' the seller will be difficult. For these reasons I may just keep them but can I then give them negative feedback? Thanks

  • I would be tempted to say that feedback extortion is against ebay rules. Return postage is likely to be considerably cheaper than paying for re-healing and having the soles replaced. I would return them via a trackable method and put in an item as not described claim if the buyer doesn't refund promptly following receipt - you could also try persuading them to refund p&p!!!

    If i was the seller i would say return them if your not happy.

    Partial refunds just stink of scammer to me, You either want them for the price you paid or you dont.

    It's difficult to meet minds on a used item, they seller may well have looked at the outer boot before listing and felt they looked in good condition, define lightly worn. a good pair of boots could last years of daily winter wear, have they been worn daily for one winter, occasionally in several winters? it's diificult to define.
    What would they cost new? what did you pay? were the photos a true picture?
    Is the tread smooth but wear in them left before resole/heal required?
    If you are completely dissatisfied with the boots, the seller has offered a return option, go with it, if you are just a tad disappointed with the condition - you are buying used boots - no harm in testing the seller for a partial refund, but if it's a no go, the seller has probably sold in good faith the price is fair and they gave a good description.

    A neg is unfair if you have been offered the opportunity to return them, even at your own cost.

    Did you pay using a credit card?

    If so, contact them. They are liable as per the normal rules when buying using a credit card.

    I have much more luck with American Express than either ebay or paypal.

    You don't get the same protection when your credit card is used to fund paypal as you do with a straight credit card transaction.

    Why would you contact the credit card company when the seller has offered their money back?

    Why go straight to a credit card where there are easier options here.

    OP You could go for a SNAD claim on paypal, you would almost certainly win it but you will still need to return the boots via tracked method before you get your refund.

    AS for feedback that is something to consider only after the very end of the whole thing, when is is all over. The fact though that the seller wants to 'check ' the item would make me inclined towards a neutral.

  • Credit cards I thought only gave protection if you spent over £100?????
