ctm - there are 3 reasons
1. Because we know others who have worked at the same place and whose tax has been refunded without them having to do anything & it may be resolved quickly.
2. To ask his employer if he has completed a P46 and if not to ask for one
3.Because i phoned the tax office 2 weeks ago and they said he should wait & call them in 4 weeks!
I assumed he was on emergency tax, I was questioning why his code was different to the one assigned to this.0 -

For a start, they shouldn't have told you that. Your son should ring again and ask them to do their job now and get a correct code issued. If they fob you off again like that ask for their manager and make a complaint.
Filling in a P46 now will take longer than gatting HMRC to sort it out now. All that will happen is that the P46 will be sent to HMRC to await them dealing with it and issuing the correct code (assuming the employer follows the PAYE procedures correctly).
When your son rings HMRC he will need his National Insurance Number, his employers name, and the address of their head office, including post code, and their PAYE reference if he knows it. He should explain his employment history from 6 April 2006 to date saying if he has worked previously or not. They will then be able to set up a record for him and issue a correct code. It's just cutting out the middleman of filling all this info on a P46, giving it to the employer for then to give it to HMRC for them to eventually deal with.
I would have thought that as your son want's any overpaid tax back, the quickest method would be preferable.0 -

With respect ... that's getting a bit silly. If there's a question mark over whether a P46 has been completed - and was it correct - the employer isn't a bad starting point. But, for the reasons you allude to regarding the refund being better in his pocket than with Treasury - I'd do that now.If you want to test the depth of the water .........don't use both feet !0 -

He works for a very large company so by rights they should know what they're doing.
He's not sure if he completed a P46 or not but says he wouldn't have ticked box C.
He plans to talk to his employer but if nothing is sorted in a couple of weeks, I'll get him to call the tax office.
It's very reassuring to know he will get this money back as he is in full time college so can't earn very much.

Tiamarie - may I just add if this is his 1st payment from his employer they may have decided to use BR until they sort out the tax code - this happened for my other half, his 2nd payslip showed the correct code. No idea why but recently larger companies seem to be adopting this crazy way of dealing with new employers.
Please do not assume larger companies know what they are doing - from experience many use PAYE software to work out wages, this is fine but new starters or leavers have to be inputted manually into the system and allocated a code from the individual inputting the data. P45 is easy you print one out when the employee leaves.
P46 is a different matter and many employers expect a p45 from old employer - as people are paid monthly you may not get this until wages are calculated at month end, this may account why BR has been used - an inexperienced person may assume that this is the emergency rate
( as some on here have done, its an easy mistake )
My advise your son needs to ask the wages department nicely if they have a PAYE code for him (normally women so use his male charm ) other than BR and if not, if they wouldnt mind letting him fill in a p46 and submitting it to tax office.
Ok this may take 4-6 weeks but on the plus side - he's not gone over their heads ringing the tax office. The other plus is he is saving some cash in overpayments ready for xmas or the sales.
oh by the way if he's chatted up the girls in wages he could drop in 2 weeks later to see if they have heard anything from tax office, if not ask them if they could ring tax office, Ive had tax officers fax me a copy of the new code the same day followed by paper copy within the week. Always keep in good books with wages works wonders. (Ive always found you get more help if you are nice than nasty or rude )Thanks to everyone who posts comps :T0 -

Do you know if the emergency tax is being applied on a week/month 1 basis or cumulative?
If you are not sure can you advise gross paid so far and tax paid so far?0
