Help needed over a claim

Basically can someone give me some advice on this ...

i took my car for an mot friday 12th november, the car failed on parking break, so as you do we got it repaired on the monday and asked the garage (who doesnt do MOTS) to sort it out.

He was fine with this saying he will take it to the station round the corner and all was good, 4pm we had a phone call saying the car was on the ramp but the ramp had collapsed (see photo below). When we went obviously we took the picture which shows we had nothing to do with the incident, the garage said yep its our fault but we will "make it right".Not a problem as we had children and needed the car we told them we wanted a car, the car though is a N reg rover which said for sale 200 on it, it gave a phone number and under the number said "for more details ask in travis perkins" which is a local builders merchants.

On asking the garage about this he said no it was his car and was insured on his garage insurance, which he hasnt showed us.

the car can barley reach 70mph as we have alot of motorway driving we dont feel safe in this, all the panels inside are hanging off, no radio, the blower doesnt work on anything less than 3rd speed and the fuel and temperature gauge seem to do what they like.

spoke to the insurance company today again and asked about a courtesy car off them, they said they are willing to give us one if we make the claim, but they said if the garage isnt negligable it would be our claim as if we had crashed, asking was he serious i was told " if it was beyond control of the garage it isnt there fault" which i find hard to believe.

how do i get a courtesy car without it affecting my no claims as i was 2 miles away from the car and no way at fault?

the car to prove it wasnt me!

    Obviously you need to make a claim if you want your insurer to provide you a car. Then the issue of liability would be in their hands.

    If you are certain the garage has been negligent and that they are liable, then you could hire a car, pay for it yourself and then pursue the garage to reimburse you.

    Talk to the garage, tell them you want an equivalent or better car not some POS Rover and if they don't give you one then you'll involve your insurance company or a claims handling firm.

    Collapse of a ramp is a serious H&S matter and I suspect the last thing the garage wants is an insurance claim where the first question will be "When did you last have the ramp load tested & inspected?"

    cheers for the quick response, my partner has headed down to the garage ( on her way home from work) to try and sort something out, i informed the HSE as i didnt think they would report it, he seems to think its a bad accident.

    i will speak to the insurence company again as i am not happy with what the young fella had to say ...
