Help with P45/P46 issue.

Hi,

Ill start by saying that i have been on Income Support and Disability Addition for 4/5 years now. Before that i worked for 6 years. I am now feeling better and my condition is under control and i decided to type up a new CV and apply for a job. I managed to secure the job and i start in 4 weeks. Only problem is i mentioned that i had been working P/T for the past 3 years mainly in the Summer months at a local Golf Course and that i currently dont work there as of August.

Now will my employer ask me for a P45 which i obviously cant give to them. Im worried that if they find out that i havn't been working then they may cancel my contract. I feel as if i would never of got a look in if i told them that i had not worked in nearly 5 years. So i was kinda in a vicious Cirlce. I've checked online about P45 and P46 forms and i dont think any of them will apply to me? So what do i say to my New Employer when they ask me for all my Bank Details and previous P45/6's etc? Do i get a special Tax code being on Income Support or any special forms i have to request?

Thanks for any help in advance.

Regards

Kevin

  • From my understanding you complete a P46 if you do not have a P45.

Seconded. Ask your employer for a P46 and complete it. It is not uncommon for a new employee not to have a P45.

I think you get a P45 when you come off IS? You definitely do with JSA.

Unless they just don't... Which also happens. (I never got mine and had to fill in a P46). It's a simple form, just make sure you are on the right tax code a few months down the line.
  • Thanks for all your help. I managed to speak to someone in my local Jobcentre and they told me that when i come off Income Support ill get a P45 and ill most likely go onto Emergency Tax for a few months.
  • Fill in a P46. the employer will send it to HMRC and HMRC will send a tax code to the employer. The tax code is designed to ensure an employer deducts the correct amount of tax from your pay without the employer being able to find out anything about your work history. The P45 might take a while to get to you so the P46 is the better option in my opinion.

Yes you will get a P45, but please be warned, the reference number that is shown on the P45 may mean nothing to you, but to an employer it will signify that you have just recently come off benefits.

The only way to defeat this situation is to fill in a P46.

It probably doesn't matter to some but to others they may not want to disclose that they have been claiming benefits.

I would just complete a p46 then your employer can get your tax code sorted straight away, when I came off jsa it took them about 2 months to send me a p45 out.
