I won item,sent cheque,but not get item

Hello everyone,

I have a problem with a seller on ebay.

I won an item on ebay on Xmas eve. I chose to pay by cheque, so I emailed seller after winning to inform her that I'll be sending a cheque, but I also wanted my item sent by Recorded Delivery, & whether the seller would consider that & I'll pay the 65p extra cost.

I didn't get any reply. The seller stated payment must be made within 7 days. But I went on holiday from Christmas day and didn't get back until the 30th of December 2004. Whilst on holiday, I checked my emails several times but got no reply from seller.

So when I got back home, I emailed seller again, and still didn't receive any reply about the Recorded Delivery option. I really didn't want to have my item sent by normal post as I've had quite a few of items lost on the way.

The third time I emailed seller, I finally received a reply on the 6th of January 2005.

Seller said: "hi this is the 1st email i have received from you its not a problem if you want to pay the extra then i will post it recorded i cant send another invoice as i already sent a reminder but as you have already worked out the price & you know ow much to pay if you want to carry on the transaction its fine by me , thanks - mel"

Unfortunately, my grandfather just passed away earlier that week, on the Monday, 3rd January, and I was too depressed to go out or do anything. So I didn't actually post the cheque until the weekend.

Suddenly, on Tuesday 11th of January, I received a Non-Paying Bidder report from ebay, and when I checked my feedback, she left a negative the same day.

I was really upset & tried contacting her to ask her to remove the feedback, & also explain the lateness of the cheque. I explained it in the letter accompanying the cheque as well.

I didn't receive any replies to my emails. Finally last week I emailed again, & the seller said she said payment was to be made within 7 days, that she said I gave too much excuses (including my grandfather passing away), and it's all boring to her, and that she binned my cheque & refused to send me the item.

The last email I received from her was on Friday, 11th of February and this is what she said to all my emails asking about the cheque and the item I won: "this is boring all over a £1.99 slip you must lead a sad life"

I have copies of all my emails to her, and I don't think ebay will help as I've had troubles with sellers not sending stuff in the past and ebay didn't help.

Could anyone offer me any advice?

    The first thing is call your bank and stop the cheque. Otherthan that, just put it down to experience and avoid them in the future.

    Tell them it was lost in the post, otherwise they will probably charge you for stopping it.
  • It's obviously upset you and i see you have also left a neg for them in reply. Have you asked them whether they would consider removal of feedback by mutual agreement? For an item of such little value, i don't think its worth the hassle, but if really can't let it go, then you could always pull up their details and try and talk to the seller on the phone.

    Other than that you could report them as a non performing seller to ebay.

    I understand from the tone of the original poster that they are upset, and I am sympathetic to that.

    But I do not see what the Seller has done wrong here.

    The Sellers T&C of sale are payment within 7 days of Auction end, and actualy gave 9 working days allowing for the Xmas holidays - Or 15 days in total.

    it was the buyer that changed the conditon of the sale, and caused the problem by wanting something the seller had not offered ie. Recorded Delivery.

    Its time to forget it an move on.. IMHO.

    Not answering any emails from the buyer, agreeing to post as requested, then going back on the deal.

    But they took longer than 7 days to answer the buyers email. Apart from that anybody that has an auction finishing on the 24th December and has a 7 day or I neg you policy is a plank.

    Hardly a big change, and the buyer was offering to pay the extra. If the seller didn't want to do it, all they had to was email "No" by return.

    you are assuming that the buyers e-mails went through, we all know that spam filters have a very good habit of blocking e-mails... from e-bay..

    The buyer also sent a second invioice indicating that they had not received the original buyers e-mail.

    Pinkyler does not mention when this was received (if)!!


    Communication was received from the Seller on the 6th Jan,agreeing to recorded delivery, but Pinkyler by their own admission did not send the check until the weekend either the 8th or 9th.. assuming it made the sat post (8th), could not expect it to be delivered unitl the Tuesday 11th, a futher 5 days, from when the buyer & seller had a confirmed commication.

    The seller, waited 15 days before a Neg, and 5 days after Pinkyler agreed to send a check.

    And we still do not know if the buyer cashed the check... or just dispossed of it.

    I think this is a great case of "handbags at Dawn"...

    Complain to EBay. Again and again until you get a response. Agreed that in 95% of cases they do nothing, but it pays to be tenacious. If you do nothing then you will never know. It's worth a try.

    Don't bother stopping the cheque, unless your bank will do it for free, it will cost you more to stop it than you paid for the item.

    I appreciate the comments made about the sellers t&cs (pay within 7 days), but I must agree with Altarf and say that this seller is obviously a joker. They should have responded to the buyer a lot sooner. They have now received the cheque and binned it, that's pretty pathetic when they could have simply sent out the item and all would have been sorted and everyone happy.

    As mentioned also sent a feedback withdrawal request. If the seller agrees, then the feedback will be withdrawn, and your rating will return to what it was, although the comments will remain on record. But this is miles better than a negative on your account for a stupid reason.

    Also consider contacting the seller by phone to discuss things.

    I agree with earlier answers, move on. This is to much effort for a £1.99 item.

    As a seller if someone took the best part of three weeks to pay me then only paid after I started NPB, then phoned me after I had left feedback I would consider that harrassment. There is no point in phoning, the seller has left feedback and it cannot be withdrawn now.

    In future it might be best to check before an auction finishes whether the seller is happy for you to add an additional 65p and insists on recorded, if they don't answer their e mail don't bid. Also, consider only using paypal, that way it is up to the seller to get the item to you, if they don;t you can start a chargeback.
