Backdating DLA

My sister was on lower care DLA. In May this year she asked for her award to be reviewed. She has just been informed that she has been upgraded to highest care as from 31 September. Can anyone tell me if the monies will be backdated from 31 September to the present date. I am asking this because I have just noticed in another thread that the new government have stopped backdating claims.

  • did she fill out a new form? if so was it date stamped? if yes then should be backdated to when form was stamped,hth

    Yes the monies will be backdated to the date the new award was made (31st September). She will receive a separate letter confirming this.

    Summerof0763.....the OP advised that her sister had filled in a review pack, not a new claim. Therefore the new award will only kick in once she has had the increased care needs for the qualifying period of 3 months (I'm assuming therefore that when filling in the form in May she advised the increased needs started then, hence the 3 month qualifying period bringing her to September).

    apologies where did i say "NEW CLAIM" i said if form has been date stamped,would be backdated to then.

    In August I was awarded LRC/LRM for 3 years on renewal of my claim but as my condition had changed since my original claim 2 years ago I asked for a reconsideration. I was recently awarded HRM/HRC and it was backdated to the date of my renewal in August - 9 weeks of payments paid into my account within a few days of getting my letter confirming the new award. Your sister should also get a letter in a couple of days time to tell her how much will be paid in back payments (my letter arrived the day after the money went into my account).
