    That idea is pure genius!

    I and probably 1,000's of others would welcome that suggestion. It would certainly weed out those that see this and other benefits as a meal ticket and use it as a basic income topped up with p/t work off the books.

    However the whole ESA system would have to change, because even now, despite people saying it is hard to get onto ESA, some including myself have managed to get on to it, despite failing the medical and having a reconsideration and getting it that way, even though NO evidence/reports of illnesses or disabilities has ever been produced to anybody.
    Don't ask how this is being managed - I would love to know - in fact I have appealed against it!!! Hoping to find that there is a flaw somewhere that needs to be closed fast and quick!!
    I would willingly submit my evidence if asked to, I have nothing to hide and am a genuine claimant. What about the others?


    You mean you never supplied any 'claimaint' evidence by filling in the initial form or phone consult detailing what the problems were?

    You never filled in the esa50 form detailing in more details the problems you face, what is wrong with you etc?

    You never sent in a fit note (or more than one)?

    You have confirmed they never wrote or rang your gp, or anyone else invovled in your treatment?

    You never had an assessment?

    You never wrote any extra detail in the request for a reconsideration?

    They just rang you up one day out of the blue and gave you esa?

    I am not 'chasing' after you, it just happens that the postings that are of interest to me, you have already replied!


    Finding a solicitor that has experience in Benefit Law is like looking for a 'flying pig'!
    Do they actually exist?
    What are the costs if you find one - can you still get legal aid?

    Ha ha no I didn't think you were stalking !!

    Yes me - 19 years for my sins ! If eligible for legal aid then yes we take the case from beginning to end. Not for much longer though as the wonderful Condems say there will be no more legal aid for welfare benefits work. This will affect CABs, solictors, law centres and others who are funded in this way

    Yes I filled in the ESA1 just stating what my illness was - nothing else - not how it affects me etc, just what was shown on the MED3

    Yes I filled in the ESA50, and just ticked the boxes. No other info sent, how it affected me or whether it was variable.

    Yes I have sent in three up to now.

    They have not seen any independent evidence and I have had it confirmed by my GP and Consultants that the DWP have never been in contact with them.

    Yes I did and failed miserably.

    No, nothing just that I appealed because in my opinion ATOS had got it wrong. No further info - in fact I have been sat on all of my evidence since June and nobody has seen it or asked for it. I was going to send it to the Tribunal when I had my date.

    They just rang you up one day out of the blue and gave you esa?

    No they wrote to me 10 months after the reconsideration (which I also failed in Feb) saying that they have looked at it again (the Tribunal that is - but now found that this isn't true - the DWP decided and told the Tribunal) and decided that I am to be put in the WORK group.
    And sent me two giros totalling just under £1000.

    You tell me what the **** is going on? They just can't do that, I wanted to go to the Tribunal to argue that I should be in the SUPPORT group. I don't accept that this decision can be right, certainly not the way they have done it!
    Honestly, the DWP or the Tribunal have no more evidence now than they had following the ATOS medical, 11 months ago!!
