Insurance claim help
How comes you never appreciate how difficult having an accident is until it happens to you!
Ok here is what happened to my partner, she was reversing down the drive and stopped as she noticed a van approaching she popped her handbreak on but never took the car out of reverse the van proceeded to pass her car and in fact managed to miss the passenger side of the car without any problems, my partner could then see the driver in her rear view mirror and he was looking to the right to make sure it was clear before turing left as he saw it was clear he accelerated and turned the wheel managing to mount the dirt mound of our drive and hitting my partners car at the same time!
Ok so the driver gets out of the van shouting at my partner (while my daughter is sat in the car!) telling her that no matter what he has done it is her fault because she was reversing!
There were no whitnesses and the insurance have called my partner to tell her that she needs to accept liability i have managed to call them and refused to accept this, i have since been out to take photos of the tyre marks he left on the grass verge and havent heard back from the insurance company yet.
So does anyone know where we stand and how to fight this case?
The car has now been written off with estimated damages of £3k so the insurance company want to scrap the vehicle today, i have managed to put them off a couple of days because i need the stereo out of the car but i am worried we will lose any evidence that shows how the car was hit, the insurance just don't seem to want to know!
Any help or advice greatly appreciated!
