3 month qualifying period for dla

My granddaughter was diagnosed with type 1 diabetes. A claim was sent to the DLA and although she has been awarded the highest rate care allowance it has not been backdated. Apparently now the DLA do not count the first 3 months of any claim - have anyone else found this to be the case?

  • I did not think they backdated the 3month anyway It is just a condition on applying. I did get a few weeks backdated but mine was under special rules.
  • yes, they did, but i believe this all changed when the new government steped in. no more beniefits to be back dated.

  • This is correct - the first three months are not counted and haven't been for several years. My son was born with major health problems requiring substantially more care than most babies, and although his DLA was awarded at high rate care uite quickly, we didn't recceive any until he was three months old. This was just over twelve years ago.

    How long did she have the care and /or mobility needs for when the claim was put in?

  • She was diagnosed and began treatment of injections immediately that was the 1 August. The diabetic nurse who will be taking care of her case gave us the forms to complete and said there was no hurry as any monies would be backdated. The form was sent in September to the DLA. She has been told that her first month's payment will be in December (Nov-Dec). I also contacted CAB and they said it should be backdated to when the form is received by the DLA - I don't know what to believe now!
  • im sure when the cuts were announced, this was one of them, no more backdating, but you have to have had it for 3 months prior. give them a buzz in the morning.

    To get DLA, you must have had the needs for at least 3 months and expect them to last for another 6. This is for adults and children.

    CAB are wrong - if you apply for DLA and have had the needs for one months, you won't get payments for 2 months. it's only backdated to the first date stamped on the form if you've had the needs for at least 3 months prior to claiming.
