    Exactly. The two children living with me (NRPP) and my husband (NRP) are ours, not his step children. (and to complicate matters even more, they were here before we even knew about my husband's child with the PWC)

    On CSA2, no. They only need your details and tax credit amounts.

    There NOT getting a cut of our CTC. They can take 15% of my salary but not 15% of my CTC. I WILL fight this!! Absolutly disgraceful!

    Good luck, but I fear it will be in vain. It is their policy to take child tax credits. Not much we can do about it.

  • You can't fight the CTC I'm afraid - it is unfair but it's the law. If you don't declare it, you'll possibly get a fine and have to pay arrears. It's not worth it - you won't win.
    I agree with above comments - stepchildren should be disregarded completely and so should CTC - lots of the resentment from PWC's and NRP's are regarding these 2 issues. I do agree with WTC to an extent - they are part of your working income.

Although we are entitled to receive CTC we don't actually receive it as they made an overpayment to us some time ago and now they are clawing it back. So presumably when the CSA work out what my husband should pay his ex-wife they won't take the CTC into account???
  • I think it's only if CTC is being paid to you because then it's an income. They ask for the latest schedule from the tax credit office and work it out from the figures on that.
    However, the CSA make up the rules as they go along so who knows!!!

    But if you have had an overpayment already then you have had more income that you needed to pay the maintenance.....so why should the claw back be taken into account? I realise that CTC ALWAYS produce an overpayment to begin with but the ruling from HMRC is that you should budget for that overpayment in order to be able to pay it back (I know mad but there you are) so I would imagine that the CSA will take your entitlement rather than the amount you recieve.

    Otherwise there would be some people who would not claim until after the assessment was made, and then they would back date it :eek:
