Paypay dispute

I have had to start a paypay dispute over a coat I didn't receive. I have emailed the seller a number of times but she just kept telling me to keep waiting and when I finally asked for a refund or a replacement she said she couldn't give one until royal mail had decided on compensation and even then they would only pay up to the value of £40 so I would loose out...
So I am well out of the 7 days ebay says I have to file a complaint following the estimated delivery time elapsing. Will they still look at the dispute or am I out of pocket?

You have up to 45 days to open a dispute. I would escalate it now for a decision as the seller is obviously not going do anything. When the seller can't prove delivery paypal will refund you your full original payment.0

Assuming that you mean a paypal dispute, then you have 45 days from the date of payment to raise an item not received dispute. Go to your paypal account and start this now. The seller will have 10 days to provide proof of delivery and if they can't you will get a refund.
Ignore anything else the buyer says. If she failed to send the coat by a trackable means and with adequate insurance then it is her loss.

I have just looked at the case (didn't know you had to do this) and she has said again that "it is not her responsibility to refund for a lost item". How do I escalate this? It seems stupid just to keep going back and forth saying the same thing! She said she was a seller with 5 years experience and a business seller. She has 2758 feedback. I would have thought she would have had some knowledge about the whole process! I just wish I had a bit more!
So do I respond to her or what next? Sorry to have to ask you questions which are probably very basic.0 -
I haven't had to raise a dispute for a while, but I think if you go into paypal, open that particluar dispute, you should find a link to click to escalate the dispute. Paypal will take it from there.0

It's ok. You have to wait 10 days before you can escalate a claim with ebay, but as it happens the seller has contacted me to say the coat has turned up at her address. She is sending it back at her expense. So there was I thinking she was incompetent and she probably thought I was some sort of scammer. Such is the way of the world...

she still needs educating a bit though; its totally her responsibility to get the item to you, she's going to get some nasty shocks pretty soon if she doesn't get her head round that0
