It might also be worth writing to your ex-employer and requesting, under the Data Protection Act, copies of all documentation the company hold about you. This would include records of any disciplinary action, and both written and electronic data is covered. You would need to pay a standard £10 fee to cover (I think) administration costs. They are in breach of the said act if they do not comply. I'm not sure how long they have to send you the information, but perhaps someone else knows the legal specifics.......If you lend someone a tenner and never see them again, it was probably worth it.0

I think you might want to ask the MD whether he will rely on a reference given verbally which is difficult to challenge in court. You might want to mention that there were personality clashes which prompted you to look for a new job...it's the time for candour. And you might want to point out that if the ex-employer really means it rather than badmouthing you and scoring cheap ego points, he'll be prepared to put it into writing, and at that point you will be taking action against your ex employer.
And ask her to request the reference in writing...and then you'll be able to get a copy under the Data Protection Act.0 -
if i were you i would follow the good advice given on here, and as for ringing the MD i would ring and say sorry to phone back but i think my phone is playing up and i think ive missed or may miss the call .... (teeny fib) and i would also put something in writing to the MD, POSSIBLY to your old boss asking what the problem is as you werent aware of it, and could you do anything to put it right so he will recosider his remarks.
Also can you get hold of ACAS or someone similar? i beleive its a free service.
hope it works out for you, i think even verbal conversations i would follow up in writing so everyone has a copy of exactly what has been said.
on a more cheeky note - and im NOT recommending you do this, but get a friend to phone ex boss and pretend to be following up a breach of prefoessional standards re verbal reference .... lol... bet he would sweat some then ... lol.
