Rental Issues, Advice Needed Please

Not even bothering, i've learned that all tenant vs landlord issues get the same response "no grounds for terminating contract"..... landlord wins every time no matter how many times they breach the contract. fact.

    The only comment I am going to make on your points 1 to 3 is that they are not reasons for you to end your contract early. If you are trully interested in resolving them, then we can help you with them, but I get the impression that isnt the reason you have posted them.

    In terms of the rent owed - your LL will simply have to wait until you get paid. You cant magic money out of thin air. He can send as many notices and letters has he wants - they cant be turned into money.

    I would simply write to your LL stating that £xx will be paid on X date in December and a further £xx in X date in January to clear the arrears with the regular monthly rent payments continuing as normal duing December and January (if that is what you are proposing). Leave it at that. Dont be baited by further letters our demands for earlier rent paymets.

    Are you sure you have claimed everything you are entitled to during your period of unemployment?

    Expect not to get your contract renewed in April.

  • Having read your earlier post before the tantrum, I would agree that the landlord is obviously not upholding his obligations and you have every right to be angry, and there are ways of dealing with these issues.

    As Planner pointed out, these are separate issues to the issue you are currently facing of not being able to pay the rent on time. Planner's response was actually very helpful, as it proposes a way you could remain in the house and make the payments at the time you are able to, is this not what you want?

    By the way - it's not reasonable to flounce off when you don't like the advice you are given, when the person was genuinely giving helpful advice to address your problem.

    Just to complete the circle - The three reasons posted by mrjam for wanting to end his 12 month contract where;

    1) Couple of loose roof tiles;
    2) No TDS protection (that he is aware of); and
    3) No gas saftey certificate.

    All valid complaints, number 3 of which is very important to reslove, just not the deal breakers that mrjam obviously hoped they where.

    A LANDLORD who unlawfully evicted his tenant has been jailed.
    Kenston McIntosh forced out Michael Hutchinson from the property, in Balfour Road, Blackbird Leys, Oxford, in March.
    McIntosh, 51, was jailed for three months at Oxford Crown Court on Friday after admitting unlawful eviction.

    Sorry to hear of your probs, particularly gas safety cert (LL must be barking)..

    When people are under stress they may act in a specific way, which may sometimes be seen as a lapse in manners. However, none of us are obliged to post a response to an OP's query, we *choose* to do so.

    People can take what's offered or not, but we don't know their full position and what they may be dealing with at the time.

    mrjam - if you have issues with your LL which you cannot resolve get in touch with your local Council's private sector housing officer. Criminal offence for LL to fail to get annual safety check done and cert issued. Get yourself an audible Carbon Monoxide detector in the meantime.

    LL is legally obliged to keep exterior of building in good condition - google Section 11 of the LL & T Act 1985.

    As Planner says, make your payment offer in writing to the LL.
