Car accident with 3rd Party insurance how to claim against driver denying liability

Accident with two cars and the driver (who I believe is at fault) is not admitting liability.

As my insurance is third party fire and theft car insurance (meaning my insurance company isn't interested in helping me chase/prove it was their fault) to go about reclaiming the damage he has caused to my car apart from recommending I speak to a solicitor?

I asked wouldn't this be problem be resolved if they think they are in the right and chase my insurance company for money and be proved wrong they would/should then have to pay me? The reply was that interestingly some people deny it is their fault but don't make a claim!
*(they wouldn't have a similar 3rd party policy with the type of car being driven!)

What my the best course of action to prove it is their fault and claim this money back needed to repair my car?

Someone has mentioned MAPS Legal Assitance a 24 hour accident claim line but didn't want to take this route without having had some advice from some of the users on this board. :beer:

Unless you know what you are doing you are better consulting a solicitor to see what your chances are here. (If liability is disputed it will be up to you to prove the third party liable.)

If you have a solicitor talk to them, or speak to one who gives you a first half hour interview free. Alternatively discuss with a claim handler (on no win no fee). They generally only take on cases they feel are bound to win!
