deposit problem and llord has not protected

  • ok.. we have send letter asking to validate the charge
    and also a letter threatening court as deposit is not protected.

    my guess is he will refund the remaining 1195
    rather than have to put 3220 in the scheme (which he probably hasnt got)

    does he have to physically transfer 3220 into the scheme? is thta how it works?

    I would forget about the deposit being protected as this seems a moot point. I would do as N79 suggests in post 2 and send a letter before action and open a claim for the missing money if he won't pay up or justify the figure he is retaining to your satisfaction.
  • thats probably what will happen.. the weight of the 3x deposit letter should ensure he repays the deposit..

    just to question again, if he needed to protect the deposit.. does the landlord literally have to transfer over £3220 to a scheme..

    cant see him being too keen to do this, especially as its common knowledge he has cash flow problems.

    still fancy going for this though.. shame its unlikeley now he paid up
  • Now, now don't be greedy! You've got the balance of your deposit so have achieved what you wanted which is entirely reasonable. Congratulations!

    In answer to your question about the LL having to physically part with the funds: the answer is "yes" and "no". One scheme requires that the funds leave the LL's hands and two are insurance-backed schemes where they do not.

    was there an inventory signed by both parties on move in and on move out ?

    What does your tenancy agreement say about water charges ?
