Insurance claim help (RTA)

I was knocked off my bicycle recently by a car. The Police were called and the driver admitted responsibility. I have sought some medical attention and was advised that I had some soft tissue injuries but I'm unsure how these may develop.

My bicycle is wrecked. I have had several telephone calls from the man’s company (he was in a company car) regarding replacing the bike but no mention was made of my injuries. I answered the last call but it was not convenient and said I would ring him back. Thinking about it now though, I'm unsure what to do as I don't want to ring and jeopardise any claim I might have against them for injuries etc.

I’m unsure where to go from here in terms of whether I should instruct a solicitor, do I need to ring the company back to inform them of this, where do I take it from here, I'm unsure and would welcome your advice.

    You could call into a solicitors and ask. Most of these will give you a free half hour consultantation.

    If you are going down this road, no pun intended, do not contact the company, ask them to carry out any business in writing and
    pass on all corespondence to whoever is helping you to make the claim.

  • What is the nature of the soft tissue injuries? If they are anything other than minor in nature I would advise looking to instruct a solicitor at this point. You don't have to do that, as technically you have three years to bring a claim for personal injury, so if you want to see how your injuries develop there is nothing to stop you holding off for now. However, equally if it is clear that your injuries are sufficiently bad that you will want to claim in any event you might as well instruct a solicitor at this early stage and allow them to take conduct of the issue.

  • Thanks for all your help. The added difficulty is that I only recently started a new job for which I need to be ultra fit, also I am currently off work so I will need to claim for loss of earnings and due to the job I'm unsure how long I will be off.

    Jamie - the injuries are minor in that I do not have any broken bones but I am in some pain and a solicitor will possibly use to offer physio straightaway (rather than going thru the NHS) so hopefully this will aid my recovery.
  • I've been with my girlfriend now for 2 years, and 2 years before I met her she was diagnosed as having a Cancerous Malignant Tumor on her head, which was removed and has been clear since then.

    However, whilst looking through her mortgage details the other day we came across her Self Assurance mortgage insurance details! I was going through it as we're both considering moving house to get a bigger one to start a family and it was then that I noticed the policy pays out if you have been diagnosed as having a Malignant Tumor (Cancer).

    Obviously it's been 4 years since she had the cancer, but it is still the same policy she had then and has never changed it! Can she still claim on her policy, even though it was 4 years ago!

    Please can someone advise!
