esa/jsa catch 22

Hi can anyone help me. I was on esa and due to ill health on the day of a medical apt i was unable to go this resulted in my claim being stopped as I had put down on the form in error what what was wrong that day not what the underlying health problem is I have . Originally DWP were going to either restore my claim or may have to set up a new claim they said this was back startaugust. I finally had my nurse medical 02/11 she says I am fit for work doc says no and that is why my line that DWP have is for a year. Today I get told that as my appeal was recieved 15/11 they will pay me at the assement rate as of the 15/11 and if win my appeal which maybe march I will get it back dated . If not entitled to ESA surely then JSA but as doc signed me off not fit for work no im not entitled to it. DWP say Im in a catch22 well that fine for them to say but no money from end july and none till end november is hell because my husband in work and just above the limit for help I get nought our rent is high Im just sicl of it all and the lack of money and getting duff information is causing rows. Is there anything I can do?:mad:

    Sorry but your post is really hard to understand.

    Your doctor hasn't signed you off from work as you're not in work. Go back and ask for a fit note and then you can claim JSA based on the sort of work you're capable of doing at present.
  • i was on Employment and support long term due to a bank injury giving me constant spasms and pain and also severe anxiety and depression.
    i was ill when due to go for medical in july and when was asked to say why on form i stated the illness i had that day not what is actually wrong with me longterm in error.
    DWP said they would try to restore claim or start a new claim.
    From that day I was not in receipt of any payments.
    Medical was on the 2nd november and result is not entitled to ESA now.
    Appeal went in 15th november but I have to wait on that decision going in my favour to recieve payments from end july to 14th november. if i loose appeal not entitled to Job seekers allowance as doctor says im not fit to return to work. so DWP sayed today I could end up with no money for that period. period we are in financial trouble as I previously worked full time and for the last 3 and half months I have had nothing.

    My doctor has advised I have permanent problem and they are trying to prevent me ending up on morphine based painkillers at the moment. I am also on anti depressants and occasional sleeping tablets due to pain. I am awaiting an apointment to be seen again by the community psychatric nurse on my doctors recomendation.

    Basically im not fit to work

    Does this seem clearer sorry but i am so fed up with this and i am a bit nippy just now:o

    I am not having a go but it really is not much clearer than your first post.

    I think you were correct to say why you could not attend on that particular day as opposed to your long term problems.

    All I can say is that you will need to wait for your appeal to be heard unless the DWP make a reconsideration in your favour.

    They've told you they will pay you at the assessment rate of ESA
  • Today I get told that as my appeal was recieved 15/11 they will pay me at the assement rate as of the 15/11 and if win my appeal which maybe march I will get it back dated .

    If that's right, they are going to pay you the ESA flat rate until your appeal is heard.

    Which is what happens to most people.

    So the money should be goin into your account very soon.
