Am I really at fault? He was illegally in bus lane!

Hi,
A Second opinion on this would be most welcome...I feel I've been duped! Below is my description to my insurer following a crash last week. Apparently I'm at fault even though the other guy whohit me did so as he was driving down a closed bus lane - has anyone any experience or opinions to offer?

PH was driving down Bradford Road and turning right into Marlborough Road. The third party was driving in the opposite direction down a closed part-time bus lane (bus lane in use 4.30pm-7.30pm Mon-Fri). All other traffic coming in opposite direction was in the second lane due to the bus lane being closed to other traffic. The other cars were queuing in this lane and one flashed the PH in order to let him through the gap and into Marlborough Road. The PH saw no bus coming. Turned right and was hit on the passenger side of his car by the third party as he drove down the closed bus lane in order to avoid the queue.

It's quite likely you were at fault or even partially at fault eg 50/50.

OP there is really no point bringing up a question you have asked already. You won't get different answers. A car flashing it's lights at you just means it's there.I'm not cynical I'm realistic

Sorry but IMHO you were at fault.
You cannot assume anything and despite the 3rd party's contravention of bus lane regs,you failed to make proper observations when turning right across traffic.
The bus land contravention is an issue for the local authority and i doubt the Police would be interested.Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..0 -
It wouldn't matter if he was "supposed" to be in the bus lane - you'd still have hit him!
1) Learn what getting flashed by a car means
2) Thank your lucky stars it wasn't more serious (eg you hit a motor bike)
3) If you want a second opinion, read your dads thread - loads of opinions - all agree you are to blame, except your dad who strangely feels the same as you do!0
