Parking Ticket

Hello my wifes sister bought a ticket (it was still valid time wise when she returned to her car) but it blew over on her dashboard (probably when she shut the door) and the inspector issued her with a penalty, surely this cant be right as she bought the ticket as she does every day. Sis in law kept the ticket but they are having none of it what advise can you give us. Do we challenge them and ask them to look at the cctv when they should see the car enter the pay and display car park at that time which will tally up with the ticket? Or is there anything else we can do, i should say that she is on low income and is going to college to get qualified and get a better job (thats why she was in the car park in the first place). We have spoke to the council who operate the car park and they are adamant she must pay the fine 60 odd quid :mad: for 09.00 am to 14.00pm worth of parking and as i said that she did pay in good faith and just because the ticket blew over on the dash! Proper jobsworths here i would name and shame the council but i dont know if i would get in trouble for it.

    Can you let us know who issued the ticket. Advice is dependent on this information.
    Just reread post and its a council.
    Please copy/photo ticket and host on tinypic. Remove personal bits. Copy/paste url and put in a post.

    IMHO do not pay, appeal formally. The process is stated on the PCN and the Notice to Owner which which follow the rejection letter. You just have to take the matter to an adjudicator but you will need forum help on what to say in your letters from now on. Forget phoning the Council, this process needs to be done in writing.

    An appeal to the adjudicator adds no costs at all - she only risks having to pay the full amount (or most likely nothing). All you lose is the 'chance' to pay the [STRIKE]bribe[/STRIKE] discounted amount.

    Rather than type it all out again or copy & paste it, I would refer you to the links in the replies there, and in particular the link in my post #11 on that thread. You need to read that adjudicator's report and get your head around the fact that a 'fluttering ticket' can be appealed successfully.

    In the meantime post up a copy of the front & back of that PCN - both here and on a new thread on pepipoo forums (see link to pepipoo in the other similar thread).

    And also email the Council for a copy of the Parking Places Order for that car park while you wait for the NtO to arrive. Do not say in the email full details of your address nor mention the PCN number or it may be taken as another appeal - you are entitled to ask to see any public document as an 'interested person'.

    If you read the adjudicator's report on that other thread you will understand the importance of seeing what the Order says about the requirement to 'continuously display'.

    But is there some way you can rotate that image first? Pepipoo posters are the experts and they'll get a crick in their neck trying to read the blurb on that sideways scan!

    And you must read that fluttering ticket report in full and get that Parking Places Order.

    Have you posted on pepipoo as advised?

    You'll need to post up the whole ticket (including the whole of the front of it). The right way up, too, so it can be read easily.

    I can't see anything wring with the PCN but as I said above, you have grounds for appeal, so appeal!

    3 steps for you now:

    1. Post about this with pics, on pepipoo forums if you haven't already (as I linked before). They may see something on the PCN I missed.

    2. Appeal informally by the end of the month, based on the fluttering ticket issue and anything pepipoo suggest you add. You have possibly already lost the 'chance' to get the discount period re-offered, which would have been the case if you'd informally appealed in the first 14 days (as it says on the PCN). But the Council may well re-offer the [STRIKE]bribe[/STRIKE] discount if they reject your informal appeal (not that it matters if you are intent on appealing this to the adjudicator - I WOULD WITHOUT A DOUBT).

    3. Once you've posted that informal appeal, separately email the Council or call into the main offices to get a copy of that Parking Places Order for that car park. Do not muddy the waters by mentioning it in your informal appeal, and when asking for the Order do not mention tha PCN number in case your request gets muddled up as an informal appeal. You just want to see the Order, as any interested person can. Often Traffic Orders are flawed, pepipoo will help you find those flaws ready for if you have to appeal further.
