any help appreciated estimating for when i return to work

evening all.
i am at the minute on low rate dla on both parts,my dla is up for renewal in august 2011 quite a long time yet i know.
basically i am wanting to go back to work after xmas and am looking at the worst case situation if my dla was not succesful in being renewed,as i know they are getting very strict and it is now harder than ever to renew.
we have 3 kids and my partner works 34 hours a week,earns around £750 pcm,we get £230 a week tax credits and £190 child benefit per month
now i know our tax credits would obviously drop a bit if say i earned £500 pcm doing 25 hours a week roughly,does any one know how much tax credits a family with 3 kids earning about 16,000 per year will recieve from april 2011
we have a mortgage so not eligible for LHA.

  • What i will say is that there are NO changes to DLA,its no harder or easier to renew/claim than it was.
    You could have a look at "entitled to" and play around that,although it wont have 2011 rates installed yet.

    I won't argue with you on one point as I know the law applying to DLA is basically the same now as it was when it first started.

    But, what I cannot agree with is that the level of evidence required now as compared to say mid 90's has increased.
    The burden of proof has become much greater.

    They used to give lifetime awards.
    They used to accept the word of the claimant more then than they do now.
    Medicals were hardly ever used.
    It was very much like Attendance Allowance is now. It was not even normal to write to a GP for confirmation.

    Yes it was much easier to get in 1995 than it is today.

    If you check dmgs record over a number of years you will see that they have helped many people and given helpful, accurate advice.

    Never claimed DLA, but if the legislation is unchanged, and despite that the burden of proof is harder - that is likely IMO to be down to the fact that originally it was the DWP who did medical services and now, guess who does all DWP medical services - ATOS.....

    Schlumberger may have done them for a while (cant recall for sure), ATOS purchased schlumberger in around 2003(4?) then the DWP sealed a deal with a contract with ATOS in 2005 to do medical services....

    Do you know - I think I can agree with you on that. Yes I seem to remember that the DWP did their own Medical Services with help from outside contracted GP's and suchlike.

    Maybe that is the reason then. I didn't know that ATOS were involved that far back.

    Ironically, I am aware of a case at the moment where a Health Service provider (not ATOS) that used to work for the government up until late 09 in dealing with Civil Servants retiring on the grounds of ill health. That particular company, as it still is the case, had to certify one of two conditions.
    1. That he/she is not able to do their duties but is likely to be able to do other work or,
    2. That he/she is not able to do their duties and is unlikely ever to be able to work again in any format.
    Reports were obtained from GP, Consultants before that decision was made.

    In this case 2 was confirmed despite those same reports being sent in and a copy of the report, yet ATOS, under the ESA claim, certified that he was fit for work and consequently had to give up the ESA claim.

    Strange that one. I can understand it if they had certified 1.

    Never did get to the bottom of it other than both tests were carried out on the basis of what he could do, not what he couldn't!!!

    Didn't matter anyhow as his pension was up lifted from 10 years service to 40 years and put on immediate retirement pension at 45 - 40/60ths of his highest pay - gave a pension starting at £16000pa + lump sum of £16,000 x4.

    He has now gone back to uni at Trent to study law. Then he will see how he feels when he qualifies

    Your tax credits might actually stay the same or go up. This is because you'd be eligible for the disability component which adds £5000 on top of the allowance which will then be reduced depending on what you earn.
