ok i know i will be slated for this but please read it all first before you start..found out today that nephew's (the one that lives with us)brother has declared himself bankrupt ....i have total sympathy for those in similar situations i know it can't be easy ..but in his case he planned it !!!! he had a friend who had to go through the bankrupsy porcedure and thought hey i think i'll have a go at that ....he had a huge wedding 5 years ago followed by holidays to kenya, florida etc i asked him a few years ago if he ever thought about buying his council house (it's a beautiful house in a lovely area) and he said na not bothiering with that ...i didn't think any more of that i have to say..but have now found out that that there plan for the last year has been do their house up ...l.c.d t.v/ new suite/brand new car you get the drift ..and borrowed loads of money ..put them into accounts in other peoples names...and then declared himself bankrupt..his plan to survive for the next few years ..use the money in the accounts in other peoples names..use his credit union account (still has that in his name somehow) and breed dogs....i just think that this is a kick in the teeth for those of us who do try to work our way through debt..and belitles those who have had to go through the nightmare of bankrupsy....now this is the information i have been given by another family member (i only see him once a year if that) but he is apparently boasting about it ....do you see where i'm coming from?

yes I do see where you are coming from.
I think this sort of behaviour gives those among us that, despite ALL thier efforts, see no other option, and a kick in the teeth for all of us who pay back what we owe. Stories like this make me wonder why I bother.
But then I remember that my credit rating will be nigh on perfect soon
 Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
Theres no dollar sign on piece of mind
This Ive come to know...
So if you agree have a drink with me, raise your glasses for a toast :beer:0 -
Well ,to a degree I can see whats going on.The stigma has gone out of going bust so he wouldn`t be bothered with that. Now,here`s the bit that always causes debate.Yes he actions are probally criminal in fact I am sure they are but what the heck are the lenders up to?Goodness knows the have thrown so much money at him.Surely he would have been checked,oh probally not,if you have a half decent credit rating and can still breath you can borrow loads. All I can say is that he has committed fraud and deception and I hope he gets found out!0

pobby so do i in a way ..but then i feel guilty for thinking that...he has two kids now ....and i think of them ..0

Hiya Elantan,
You are perfectly right to be angry, however fear not, the Official Receivers are NOT daft, they are going to look into the use of the borrowings and it won’t take them long to work out what has happened, he is going to have an Bankruptcy Restriction Order http://www.insolvency.gov.uk/pdfs/guidanceleafletspdf/bro.pdf slapped on him faster than you can say Culpable conduct! Also the car and all the expensive TV equipment is likely to be sold as assets.
So although you think he may be getting off likely he is going to be in a LOT of trouble, you may even have to visit him in prison one day if he doesn't buck up his ideas.

Why should you feel bad? HE is in the wrong, and if he thought he was going to get away with it then that's his own stupid fault, you have nothing to feel bad or sorry about

Do you feel bad about feeling the way you do because he's a sort of family member? I got confused by nephews brother , sorry.
Quite frankly I think its appaling, theyre are people who struggle to get by to pay back what they owe, or even just to survive on what they have, and then fools like him think they can play the system, get whatever they want, on someone elses time and money! I think its unforgiveable and I'm surprised that any number of people in the family are still listening to him.
If that was anyone I knew I'd be absolutely livid, and not just because I'm paying back what I owe, but because its utterly illegal to obtain credit under a false name. I hope he gets found out and ends up with nothing quite frankly!
Now I'm sorry if that came out harsh but I'm actually really angered by that tale.............
