    No legal expenses cover.

Do you think it's worth speaking to her directly about the matter?

Has anyone had a situation where the matter has been settled outside of the insurance company or is this a risky route to contemplate taking?

It is risky - you would need them to pay a proforma invoice from your garage, as well as pre pay any car hire you need etc. But the problem arises if the garage find more work needed once they start, or the job takes longer and you need the hire car longer, and you are faced with trying to get more money out of them.

(Of course, if your third party is well heeled, they might be keen to deal rather than end up with a police investigation regarding their insurance!)

First, report the matter to the Police as others have said.

Second, do you have legal expenses cover?[/QUOTE]

As she is already breaking the law, I would not deal directly with her, because she cannot be trusted. Put the matter in police hands immediately.
If she is running several businesses from the property, then it could be that one or more of the companies has failed, and the insurance direct debits have not been honoured.

Clutching at straws, it has occurred to me that it is possible she is driving on 3rd party cover from a policy on another vehicle. My insurance co only referred to the fact that the vehicle in the accident was not insured and we didn't learn this til late Friday. The Insurance co dept is not open til Mon now.

andygb I have similar thoughts about the possible financial position

I did ring her earlier , but her son (? )answered and said she was not home.

*Legal expences cover really is paramount*

For 5% cost on insurance you get someone else to chase all the uninsured shiotes, £400k houses or not, for your loses.

Anyone with funds/property/money can be targeted for your damages, play the "game";), but without this cover you will have to fund it yourself;.
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed

I agree. Back when I was a penniless student I successfully sued another driver for compensation. I wouldn't have been able to afford the legal bills without the cover. The best £5 I've ever spent :) (it was a while ago.)

First give her the opportunity to rectify the problem pointing out it may end up being a write off. If she doesn't play ball, inform her you have £25,000 of legal expenses insurance as part of your policy to use to persue and sue get your money out of her.
