EDF have admitted to miss selling my contract- advise needed!

EDF energy recently sold me over the phone their annual fix 4 tariff duel fuel, advising me that there was no standing charge.

When the contract was posted to me and after I got round to reading it I noticed I had been miss sold the contract as there was a standing charge.

When I complained about this I was told that I had missed the cooling off period and that I would have to wait until the contract ended.

I argued that I was told there would be no standing charge and on this information she said they would review the tapes.

EDF contacted me today confirming I had been miss sold the tariff and that they woul let me out of the contract.

Im not particularly happy that this has happened and wonder if I should push for some compensation. They have offered to waive the standing charge for 90 days which i think is poor. What are my rights- should i push for more.

Has anyone had a similar problem and if so what did you get from the company as compensation.

Any suggestions are welcome!

  • EDF are currently under investigation, along with Souther, Npower and Scottish Power, by OFGEM for mis-selling, but more thru face to face sales channels. Given that you are out of cooling off, and they admit mis selling the tariff to you ( contract on domestic energy is a rolling 28 day, can change supplier when you want, just beware of canx charges if leaving company before tariff you've joined them on ends), EDF should erroneous transfer your supply back to current provider, therefore no charges from edf to you, your former provider will bill you as normal as if never left them, would be the more appropriate course of action for EDF to purse, unless former provider have already regained, or are due to do so in the next couple of days.

    To be fair on various threads too many folks get hung up on standing charges vs 2 tier unit rate charges, both are a standing charge. Just on a two tier unit rate tariff, primary rate significantly higher(generally) than secondary rate, but usually only paid between 170-364KWh a quarter, rest of consumption on lower secondary rate, whereas standing charge only bad if away from property regularly, then the standing charge applied to bill even thos cost of consumption minimal based on units used.

    I don't understand why people don't like the standing charge. If you don't have a charge then it is recouped in tier 1 of the cost per unit. Can you explain your thoughts? To have the standing charge waived for three months is a pretty good savings. I'd take it.

    They've already agreed to let you out of the contract and waive the standing charge for the last 3 months, the charge you were complaining about.

    I agree. If a tariff has a standing charge, it is easier to see it for what it is than try and work it out from the difference between tier 1 and tier 2 units and the number of tier 1 units. Using tier 1 and tier 2 units, the suppliers can hide some hefty standing charges.

    Cooling off period is for changing your mind on the terms of the contract as stated.

    If the contract is not in accord with what you were sold, then you have longer.

    As others say, the resolution is to waive the standing charge. No compo for you - and to suggest it makes you look like an opportunist rather than someone who has been swindled.

  • sadly, i reckon its the only way firms will learn, and raise their standards..
    Long time away from MSE, been dealing real life stuff..
