Faulty iphone Apple won't repair

Hi, can anyone advise me please? My daughter has had her iphone since March (so still under warranty) and paid £360 for it. It has now developed a fault which the man in the Apple shop said was very common and they would send it back to Apple for repair. He noted that the phone was in excellent condition. Apple has now said that it looks like someone has tried to open the phone (she obviously hasn't) and therefore they won't repair it under warranty - it will cost her £140.
It just seems like one big con to me; it's now her word against the might of Apple!!
Help! What do we do now??

i would take it to a apple store and they will replace it there and then just tell them the battery doesnt hold charge or something, i did that with my iupod touch and they replaced it no questions asked0

Out of curiosity where was it orignally purchased from?0 -
I water damaged my iphone taked it apple they said they wouldant touch it has it has been water damage and it not covered under warranty repair, searched online got to a website called http: UK-repair.com sent my iphone to them to repair 2 days later had my iphone back to me fully working recommend to all uk iphone whitout warranty good price and very good service whit warranty on the repair.

Stay well clear of this lot, I sent my iPhone4 for a replacement screen after I dropped it. They made a huge botched job of it and sent it back stating it wasn't working and beyond repair yet all that was wrong before was a small crack in the screen. I'm now talking to TS about their shoddy work. Avoid Avoid Avoid!!!0
