csa going for liability order

I would suspect that the liability order will go ahead anyway, but you really need to ask in writing for a full audit of the account as well as a total account breakdown, so you can see how they have added 1+2 and come up with £3000!!!
CSA usually negotiate any arrears to be paid off within their target of 2 years, maybe you can negotiate a reduced payment for now and get the account brekdown etc anyway. Your DP File may also be of help to back track and see how this has happened.
Truth is CSA are bullies will get LO whether debt is accurate or not, after this is secured they will start enfoecement action unless you can negotiate a payment scheme with them
Good luck, and of course send all letters recorded delivery, keep copy as well as print off from pc, that tallies with barcode on receipt as proof they recieved your letter0 -
No it's not an insult by a long shot, I just can never understand, the having the need for somebody else to do something for you (as an adult) , has he been so laid back that he has accrued the arrears unintentionally?

When you are in a relationship, you help each other and use each others strengths. My partner is useless at dealing with legal matters - he doesn't use the internet much and his writing skills aren't great -but that doesn't make him stupid. I do all that for him and as a result, we've sorted out the CSA and gone the legal route for him to get access to his kids. He's just better at other things and I rely on him for lots of the things that I find difficult.
I would much rather help him when he struggles - then stand back and watch him fail. But that's just me.0 -

Yes I understand, I just feared that the arrears maybe genuine , nobody can do everything

Took 4 sittings in court before mines was granted but the judge had his hands tied. The court aren't allowed to question how the arrears are made up or calculated. The sums didnt add up in mine0

hi all thanks for replies.also, thanks julietamber, that is what i meant to say but i am too wound up with the whole situation.DUTR, you feared the arrears maybe genuine?well if they were would I make myself look a prat to disprove them?will call csa tomorrow and see what the crack is, will also call nacsa.i have emailed them about which package would be best.I wash my hands of it.i am drained from it all.Oh and i also found 17mths worth of payments paid to one pwc instead of split with the other.that will be my main line of argument tomorrow with the csa.and the fact that we have letters etc saying no arrears owed.0

Now this is where some of the complication may arise, as technically there would be arrears to one PWC, and judging by the flavour of some responses in other threads, the overpayment made to the other PWC maybe classed as a gift, the easy option for the csa is always to milk the NRP for more as they can magic money from anywhere :eek:
There is talk on another thread about assesments based upon gross pay as early as next year, conveniently no one has mentioned who pays the tax on the gross assesments, and indeed chances are 15% net is going to equate to more than 12% gross .0 -
The only way to give the power back to the Court to look at it properly is to make an application for a Warrant of Suspension, as I say on a Form N245. CSA hate this application as it removes all power from them and gives it back to the Court.0

dutr, it will not be classed as a gift as all of the payments were made under a deo.blob, if we make that application will that leave it to the court to sort out?ie to investigate arrears,payments etc?if so, how do i get hold of one of these?go to the court and get one?thanks0

blob, just read your original post.our argument is that we have found many many discrepencies with the cases.have had many statements saying £100 owed,£10,000 owed,££329 owed,£o owed in dec 2009,it goes on!about £7000 worth of payments missing from both cases, which we have provided evidence that these have been paid, which has brought the amount down.months of payments paid to one pwc and not the other.
it is just a farce.they know all of this, they know we are currently disputing the arrears with falkirk,yet they send one letter demanding payment whilst in the throws of the dispute and then a letter saying the going for a liability order in a week!this is why i am in a tiz.wish they would just look at the flaming case properly and get it right!0 -
