Car accident please help

In Feb 2010 my older brother took my car without my knowledge. He then got involved in an accident. He went on the opposite side of the road to avoid some road works. This caused the approaching vehicle to swerve out of his way and crash into a tree.
The first i knew about it, is when a letter came through the post from the third party insurer. My brother then admitted that he had taken my car and explained what happened and took the letter a promised to deal with it.
9 months later my insurance company has contacted me, requesting that i sign a document giving them consent to represent me against a claim from the third party. They hinted i could face a CCJ should the 3rd party win this case. They have also hinted recovering losses from me. Reason being my brother is not very forth coming with his insurance details. (if there are any)
Please advise.

You get the costs and a ccj, or report it as twoc0

On a practical note, before you report it as a TWOC, find out if he does have any "driving other car" cover on his policy.
If he does, but you've reported a TWOC, then the cover would be invalid (the "other car" is only covered if driven with the owner's permission)0
