budget insurance cancellation fee

I have a quick question regarding automatic renewals. My insurance was due for renewal on November 1st, but the credit card details budget held for me expired in October. They are now trying to charge me £35 for cancellation of a policy that I have not paid for in the first place. Can they do this???:(

    If you didn't lapse your policy at the end of its year, then they will have renewed it in accordance with their autorenewal procedure.

    Now they haven't been paid, then that is a separate issue, and as a result are charging you their cancelation fee - if this is mentioned in your policy then they can do this.

    Also enquire as to whether they are listing this as a "default" cancellation which you will need to declare to other insurers - if so try and dispute this.
