Private vs Council

Hi all, im confused as to why the general consensus on here says its extortion for a private landowner to levy a charge for overstaying or even parking out of a bay on their land but its ok, to pay a council ticket, issued for similar infringements.
Be Alert..........Britain needs lerts.

    Because the council tickets are enforceable, plus there is an independent appeals process in place for these types of tickets. So most people on here suggest always appeal as there is at least a 70% chance that they find in your favour, plus you only pay the non discount cost of the ticket should you lose!
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I know this, im just interested to see people views on the topic and wonder what their view would be if the private "tickets" became enforcable and an independant appeals system put in place.
    A lot of the arguement is the astromonical cost of the ticket, but the same can be said about the council ones

  • If there was a genuinely independent (not the BPA) adjudicator then we would all (well almost all) abide by it, always assuming that the parking places were all to follow the same rules as the council. The places should have parking place orders, issued by council, which detailed the rules and charges.

    Given the generally pro-motorist stance of the coalition Government - funding withdrawn for speed cameras, imminent ban on private clamping etc. - I can't see any likelihood of legislation being brought in to make private parking tickets enforcable any time soon.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     But if a ticket has been unfairly issued by the council you have a place to appeal, with a PPC even if you have grounds to appeal its always turned down! The council also don't have astronomical costs added to your ticket unless you ignore all letters sent to you.

    The PPC and Council ticket comparison will always be there, but I don't see council tickets that are issued for having disabled badges upside down on the dashboard, or when a wheel touches a line , most council tickets are for out of time issues, a simple search on google will tell you that.

    The Traffic Management Act 2004 applies to councils.

    Private companies have no such law and can only issue invoices, like every other private company in the country.

    The sticking point would be the issue of making owners liable even if they weren't driving. The Digital Economy Bill is hitting the blocks as it attempts to make broadband bill payers liable for the actions of others.

    There already is a genuine independent appeals procedure in place for private tickets. It's just that it's up to the PPC and not the driver to make use of it. It's the county court. However, not many PPCs seem that keen on using the procedure. Heaven knows why they think we need another one.

    Yes there is that ;) out of the 800k tickets last year issued by PPCs, how many of them went to court? I would say 200-300 at the very most not quite sure on the percentage but something like 0.0001 % would be about right, and out of all the millions of tickets issued over the last 10 years or so they have won a handful through default as they were not defended properly, and won just once that can be verified!

    That just puts it into context , basically its a scam!
