Close Repairs - each persons ££ (someone awol)

5 out of 6 folk have agreed for a new door entry to be installed in out close, I cant get a hold of the 6th person. He sub lets and is off the Radar at the moment. I'm eager to progress with the works and am willing to pay his share just now however where do I stand once he shows up in asking him for his share of the works? We dont have a factor nor do we each put money aside each month for common repairs. Advice please.

    If I was away and some meddling neighbour came around one day when i returned telling me he had entered my property to fit something I hadn't given permission for, and wanted paying I would tell him where to go. (after ringing the police and reporting the break in into my property).

    Unless you have been elected as the manager or authorised by all the owners of the close, you have no business messing with other peoples property.

    Not sure where you are? In Scotland, matters like this would normally be dealt with by a clause in the titles deeds
  • just to clarify, we are only talking about replacing the main close door, not his own door flat - the door is anicent and is in dire need of replacement - with regards the door entry part (fopr his flat) this could be fitted at a later date,

    I just wondered if there was a legal; document that could be used stating that if eg: 75% of the close were in agreement to common works being carried out that he'd need to help with costs.

    Its a communal door entry system, presumably just the main unit that would be replaced. the OP is asking about whether the absent person is liable for their share of the cost if its done without their consent. Its not about forcing entry to someones flat.

    there is normally something written into the deeds regarding how costs relating to communal areas are split. I'm sure there are rules to prevent one person stopping necessary work to a communal area but whether there are restrictions on what kind of work qualifies for this or not I dont know.

    I would go all out to contact the owner and get their agreement if at all possible.

    thanks we are trying to get hold of him through his estate agents who are also having some difficulty locating him. Unsure where to go from here as due to data protection we wont get much info.

    generally you cant force anyone to pay after the event.
    the best bet would be to get the other 5 to pay his share. 1/5th each. and hope he pays up later on.
    he would find it it very hard to refuse to pay all five neighbours.
    Get some gorm.

    i don't know, if someone in my close went ahead with work, paid for it and finished it then said i owed them money, i think i might be hard to track down too!!

  • you should start a sinking fund ie a communal fund that everyone pays into.then have meetings to decide what to pay each year and what to spend it on.chou
