have we lost our cash?

a couple of weeks ago, we bid on and won a pop up gazebo, for £65 + £20 p+p, it arrived a few days later and it was the worst quality that you can imagine, like cheap net curtain, the instructions were in cyrillic ! ( russian). it was from an ebay shop, which had brilliant (but low)feedback , obviously false, we arranged to send it back at a cost of £15, :mad: we got no refund, we contacted the seller asking for refund or we would take it further, he said "well take it further then", then messaged us again saying that he would only refund the £65, nothing more. we gave him 5 days to pay up but still nothing. his shop has been taken off ebay so it would be pointless giving him neg. feedback, what can we do now? it was all the money we had in our paypal a/c , so it is a real kick in the teeth to lose it, will paypal refund us or not?

    As his shop's been removed his pp account is probably empty so pp will not recover any money from it (and they certainly won't pay you with any of their own).

    As it sounds as if you paid with existing funds, rather than with a credit card, and hence cannot do a credit card chargeback, I rather fear you have lost your money.

    Couldn't hurt to open a dispute with paypal, if you haven't yet. The chances aren't great though.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    yep have to agree with everyone, sorry to say.

    perhaps we can create a MSE hit squad for all the scammers on ebay, I must have read four threads today on MSE about people being scammed. I thought it was suppose to be getting better. definatley do a chargeback,as it will definatly cause him some grief if he ever wants to accept paypal again, even if he has another ebay account and sets up a another paypal account with another credit card, paypal will in the end spot it and feeze any assets, it probably wont get your money back but you will be helping other people form being ripped off.

  • I am beginning to wish now, that we had kept the stupid gazebo , at least we could have used the pop up frame:rolleyes: . the original cover was so bad it would not have even stood up to one day's use in the garden , the velcro straps were literally hanging off and there were holes in the canopy caused by the stitching! oh well , you live and learn. at least they never had our bank details or cc.
  • I assume you have his contact details. How about writing him a letter saying you are taking him to the small claims court. I also think you can do it online somehow.
