So, it sounds like if I deducted the tax, I could be liable for non-payment of rent, and if I don't deduct the tax, I could be liable for non-payment of the tax.
Yes - stupid isn't it - but...
a judge would be unlikely to actually make the possession order on a ground 8 (rent arrears) eviction if you pointed out that this was simply to play by the rules with tax.
and we have yet to establish if being misled as to residency is a defence against the tax liability, it might be.
the sad thing is that these rules can ruin what would otherwise be perfectly good LL/T relationships.0 -
If that is true, it puts the tenant in an impossible position, unless the LL will give him all the information he needs, and will agree to not contest the lower rental payments (i.e. the amounts after tax).
Is this really the case?
Make it the taxman's problem, I reckon....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
