I guess you would have to have your brain scoopped out to fall for this one. As to how they get away with using the Microsoft name you have to catch them first and that won't be easy. For now just be grateful that they are so obvious and bad at trying to catch anyone with their scam.

Because when you're committing criminal fraud, a civil offence of trademark misuse is probably the least of your worries
