This scenario never even happened....... just someone made up a totally hypothetical case...it never happened mate!...and IMHO nor could it.

I vaguely recall a buyer on this forum ages ago complaining that it had happened to them or someone they knew, and remarking that it's very useful for shill bidders, since if they should accidentally find themselves the highest bidder, they can retract their bid (or have the seller cancel it) and leave the next bidder owing more than they should. Bid retractions without a valid reason are against eBay rules, though, and I think there's also a strict time limit.
There is a warning on eBay somewhere (I think it's when it tells you you've been outbid) pointing out the possibility that even if you're outbid, you could still end up as the high bidder. Though I'm sure it's very rare in practice, it does seem very unfair, especially since it's common for bidders to go and bid on another item instead. If I were the seller in this scenario, I certainly would not hold the underbidder who finished as the highest bidder to the deal if they wanted to back out.
I have occasionally made 2nd chance offers, resulting in a few sales, but usually by the time I've given up chasing payment from the original "buyer", the second highest bidder is no longer interested (maybe having bought something similar from another seller in the meantime).0 -
