£190 BT Charges because of A Talk Talk Salesman

HI there I really need some help!
We moved into our new home in June and got an account with BT. After 2 months a Talktalk door to door salesman knocked trying to sell us their package, we told him that we couldn't take him up on this because we had a contract with BT, he assured us that we only had a one month rolling contract and therefore if we changed over to them there would be no charges what so ever. So we changed over but then got a letter from BT telling us we had to pay £190 in fees becauce we had terminated our contract. Obviously the salesman had lied to us just to make a sale. On phoning Talk talk they told us that we were not the first people to have been told this and that if we waited 21 days we may be able to have a refund from them in order to pay BT. It has now been a month and having phoned them on many occasions we are not getting anywhere and it looks like they will not pay out. We had sorted it with BT to place a hold on the account until the 21 days was up and we had been paid out. Bt are rufusing to wait and we have had more charges put on top and are getting letters from their solicitors. They have also said it will affect our credit rating and will be going to court. We cannot afford to pay BT out of our own money, we are both unemloyed at the moment and do not have much money.
What can I do?

Go back to BT and tell them you want to stay with them and explain about the TalkTalk chap lying to you.
Then check on here for the cheapest way to use your phone and you will find it cheaper than TalkTalk.

Thanks for the help but we can't cancel the move to talk talk as they said they would then charge us £75 and also BT will still not wipe off the £190.What goes around comes around0

E-Mail their CEO Charles Dunstone telling him your problem in detail. This usually gets things moving.

If you want to pay BT, cancel TalkTalk and if/when TalkTalk chase you for the £75, say you were missold their service. As someone else has suggested complaining to Charles Dunstone's office and you can also follow BT's advice for people in your situation. Its a well known fact that TalkTalk are letting people cancel, with no cancellation charges (even if they were not missold) because of problems with their service - and you were misled which makes your case stronger.
Its also worth complaining to Ofcom about the way the salesman misled you - regardless of how/when you get this resolved to help stop it happening to other people.
If you do actually want to move to TalkTalk (I woudn't necessarily recommend this but it depends on your usage) then call BT and say that even though you were in a 12 month contract with them, that they are not entitled to charge you £190 but a maximum cancellation charge of £18 as described in the BT Price List.

Yeah but if they had sogned up for the halp price line rental offer or option 2 for 1, the cancellation fee would not apply, and they would be held to term for the package price.The views expressed on this website, be they in text, pictures or sound, are my own personal views.
