who is responsible... landlord or tenant?

to replace a broken window pane on the front door (cause unknown, broken overnight)

    Assuming he accepts it was "trick or treaters", or similar, at fault...

    ...and has no reason to think you or a guest did the damage. Like broken glass on the outside, because it was hit from inside!

    It is only my thought, but inwards, more likely to be the Landlord, outwards more likely to be the tenant.

    I'm not cynical I'm realistic :p

    Thanks for the replies.

    Broken glass was on my door mat, so was done from the outside.

    I thought it was landlords responsibility but when I spoke to the letting agents earlier they were having none of it. I said it wasn't my fault, their reply was "Not the landlords fault either".

    I have boarded the pane up (its only about 10 inches by 6 inches). Might just copy this thread and send to letting agents.

  • Sadly letting agents frequently don't know what they are talking about. Ask them does their logic mean if the roof starts leaking after 30 years Sterling service should you pay for that too?

  • Hi Letting agent!! Suggest you read LL&T Act 1985 Section 11

    11 Repairing obligations in short leases. E+W

    (1)In a lease to which this section applies (as to which, see sections 13 and 14) there is implied a covenant by the lessor—

    (a)to keep in repair the structure and exterior of the dwelling-house (including drains, gutters and external pipes),
    Think the Judge would decide Window is "Structure or Exterior"..

    Ultimately, these and other assertions will only be proven if & when the case gets to court before a Judge: He interprets the law & decides. Posters here, including little me, are but speculating... As is any solicitor advising you.. (But, PN has several points!)
