Therefore by buying and using for personal use is a breach of the terms of membership and Makro can claim any costs for this breach, but Consumer rights will still apply as they are a consumer(as stated, this is a matter of fact just like the sky is blue and the grass is green).
This is something that has been discussed in full before, if you search for Makro on these Forums most discussions result in this debate.
So the OP takes Makro to the small claims court for the cost of the TV, Makro counterclaim for the full cost of the TV (what they're out of pocket for the OP's breach of membership) plus, maybe, other costs incurred. OP ends up out of pocket...
What's the warranty on the product? Will Sony not fix/replace the item?0 -
Actually makro are a great company to deal with, simply take it back to the returns desk, tell them the problem and they will give you a refund.0

I had a similar problem with Makro a few years ago. I bought a TV from them which never worked properly. An engineer found 3 different faults with it but Makro still wouldn't refund. They insisted the TV be sent away for repair but I dug my heels in. I got nowhere over the phone so I went back to the store and stood my ground at the customer service desk until they fetched the manager. My argument was that regardless of whether SOGA applied to the transaction I still had a contract with Makro. By supplying me with a faulty TV they had not fulfilled the contract. The manager folded after a few minutes of huffing, puffing and bluffing. I got a full refund and went elsewhere. I would never buy any high cost electrical items from Makro again, not worth the risk/hassle.0

OI! Don't use the W word here. Contacting manufacturers to get speedy resolution without going through a third party is not the done thing as a MSE!0 -

But if you contact the manufacturer directly then you are going through a third party due to the fact that the manufacturer is the third party when you purchase something from a retailer.0
