Can second estate agent market probate property after offer accepted

Hi all,

Had offer accepted on probate property.

It was marketed by two estate agents. The one we offered through took it off rightmove and their website.

However the second estate agent say with a probate property it can be marketed right up until sale.

Is this true? or can I insist owners ask agent to stop marketing it?

(I understand reposessed properties can be marketed up until sale?

Most grateful for any info on this.

    Tell the first agent you'll withdraw your offer if the second agent doesn't remove it from the market, and marks it Under Offer.

    How important is it that you buy this property? Could you go looking for another one?

    You can insist and they can say no. It looks like the second agent are trying their luck in case your sale falls through. You should not trouble the second agent [except perhaps to send a mystery shopper in their direction to ask for a viewing]. It is between you and the executors via the agent you offered through.

    Any property can be marketed up to sale, you can threaten to withdraw and thats it. I imagine the second agent would be quite happy for you to drop out so they still have a chance at the agents commission.

    Hi there - there were two offers on this property at asking price. There's very little on the market in this area of interest so I doubt I could push them if they refused. I think the best I can do is request they take it off market with second EA via my solicitor? I'd like to wrap up the sale if possible - had another fall through recently after paying out for survey. Just ordered the survey on this one so stand to lose out again if it falls through.

    Unless the vendors officially instruct the second EA to take the property off the market, it is still for sale until exchange.
  • It's up to the vendors. Until exchange anything can happen so they would have to tell the other EA to take it off the market if that was what they wanted. But if I were you I would tell the first EA to say to the vendor that you will not proceed any further until they instruct the second EA to put it at 'Under Offer' or 'SSTC'

    It is not the 2nd agent that makes this decision. It is the vendors. Whether they are private individuals, a bank with a repo, or the executers of an estate is irrelevant.

    The agent does what the vendor instructs. If the vendor is leaving it on the market with the 2 agent, the agent will market it. If they instruct the 2nd agent to take it off the market, that's what the agent will do.

    The clue is in the word 'agent'.
