Legality of Parking Fine

Hiya,
I would really appreciate any advice or info.
I got a parking fine fom Southwark Council last week. It was under the window wiper in a paper(ish) envelope that had got soaked due to the rain. When I opened the envelope there was no actual PCN inside it. Just the empty but sealed envelope.
I have checked with Southwark Council and they have confirmed a PCN was issued althoug I cannot find it on thier website to check the photos.
Where do I stand with appealing this? Surely it cannot have been issued correctly and therefore negates the fine? :mad:

The CEO will claim it was issued correctly.
Write in now and tell them to send you a duplicate.
Better yet do it in person and take a witness who can note their response.
An empty envelope often denotes what may politely be called further potential problems with the issuance.0 -
Well you have phoned and alerted them that there was no PCN in the envelope so I am not sure now whether to advise you to send in an informal appeal saying there was no PCN, only an envelope, and asking for proof a PCN was actually served.
Or whether to go quiet, wait for the Notice to Owner and then appeal on whatever grounds you can put together including the lack of PCN.
I would post about this with a pic of the lines and signs where you parked, asap on pepipoo forums for advice on whether to informally appeal, or wait for the NtO and formally appeal (or both). Start your own new thread after registering and reading the FAQs and sticky threads on this forum link, don't reply on an irrelevant thread like you have here (this MSE thread isn't for new cases anyway and pepipoo require new cases to be on a new thread):

FWIW I would appeal as far as the adjudicator ANY Council PCN, the reason being you pay no costs, there's no risk except having to pay the non-discounted fine if you lose, nothing else.
And the main thing to understand is that the majority of appeals that go to the adjudicator are allowed in favour of the motorist; in fact those cases where the wise posters on pepipoo give advice are very, very successful in never having to pay up.
HTHPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
